Terms of Service
1. Acceptance
By connecting your Google account and using the DMR Media Lead Response Bridge ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of service
The Service enables real estate professionals to automatically send personalized email replies to new leads through their own Gmail account, triggered by webhooks from lead generation platforms. Emails are sent via the Gmail API using OAuth 2.0 credentials you authorize.
3. Permitted use
- You may use the Service only for legitimate professional real estate lead response communications.
- You must comply with all applicable laws, including CAN-SPAM, CASL, and GDPR where applicable.
- You are solely responsible for the content of emails sent through the Service.
- You must have a lawful basis to contact lead recipients (e.g. they submitted an inquiry to your platform).
4. Prohibited use
You may not use the Service to:
- Send spam, unsolicited bulk email, or harassing communications.
- Impersonate another person or misrepresent your identity.
- Violate any Google API Terms of Service or Gmail usage policies.
- Reverse-engineer, resell, or sublicense the Service without written permission.
5. Google OAuth and API use
You authorize DMR Media to use your Google OAuth credentials solely to send email on your behalf via the gmail.send API scope. You may revoke this authorization at any time from your dashboard or via myaccount.google.com/permissions. Revoking access stops all automated sending immediately.
6. Account responsibility
You are responsible for maintaining the security of your Google account and for all activity that occurs under your account. Notify us immediately at team@dmrmedia.org if you suspect unauthorized use.
7. Service availability
We will make reasonable efforts to maintain availability but do not guarantee uninterrupted service. The Service is provided on an "as is" and "as available" basis. Sending windows, rate limits, and delivery are subject to Google API availability and limits.
8. Disclaimer of warranties
To the maximum extent permitted by law, DMR Media disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that every lead will receive a reply or that emails will be delivered.
9. Limitation of liability
DMR Media shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including lost business opportunities, missed leads, or failed email delivery. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Termination
We may suspend or terminate your access if you violate these Terms. You may terminate at any time by disconnecting your Google account from the dashboard. Upon termination, your OAuth tokens are revoked and deleted.
11. Changes to terms
We may update these Terms at any time. We will post the updated date at the top of this page. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
